What happens after the hearing
The Tribunal will provide its decision to each party to the proceedings. It will usually be provided in a written decision that is sent to each party. On some occasions the decision made by made orally on the day of the hearing depending on the urgency of the matter. A person can request a written decision or may be provided a recording of the reasons for decision.
The Tribunal will aim to issue a decision within six to eight weeks of the hearing. The timeframe will depend on the complexity of the matter and any existing decisions that need to be issued.
The Tribunal has a Fact Sheet with information about where you can get help and legal advice
What if I don’t agree with the Tribunal decision?
A party to proceedings has a right of appeal to the Supreme Court against a decision of the Tribunal. An appeal to the Supreme Court about a decision in the Community, Children and Families Stream can only be on a question of law. An appeal has to be made to the Supreme Court within 30 days after the day the decision was made (or within 30 days of a statement of reasons being provided). See Section 136 and Section 137 of the Tasmanian Civil and Administrative Tribunal Act 2020 about appeal rights.
You are encouraged to seek advice about lodging an appeal and the Tribunal has issued an information sheet that has information about bodies that can provide assistance and advice.
Applications after the Outcome?
Once the Tribunal has issued a final decision, it usually has no power to review or change the decision except to fix typographical errors or similar minor mistakes.
A party can make an application to correct simple mistakes such as typing mistakes, or calculations. Section 119 of the TASCAT Act 2020, allows an application to be made to correct mistakes. It does not allow the Tribunal to change the outcome of a decision.
There can be applications in relation to the costs of the proceedings. The final decision of the Tribunal will make orders about the timeframe for making an application for costs of the proceedings.
