Residential Parks

The Residential Parks Act 2026 (the Act) establishes a framework regulating residential parks and residential park agreements in Tasmania. The Act sets out the rights and obligations of park owners and residents and provides processes for dealing with matters including residential park agreements, rent, security deposits, park rules, termination of agreements, abandoned property and disputes between park owners and residents. The Act will commence on Thursday, 8 October 2026.

The Act gives the Tasmanian Civil and Administrative Tribunal (TASCAT) jurisdiction to hear and determine residential park disputes and provides for a range of applications to be made to the Tribunal.

What is a Residential Park?

Under section 3 of the Act, a residential park is an area of land used, or intended to be used, as a complex of sites together with common areas, such as bathrooms, toilets and laundry facilities, where rights of occupancy are given under one or more residential park agreements.

What is a Residential Park dispute?

Section 3 of the Act defines a residential park dispute to include:

  • a claim under a residential park agreement;
  • a dispute between parties or former parties to a residential park agreement about matters arising under the agreement or the Act; or
  • any matter that may be the subject of an application to TASCAT under the Act.

Section 95 provides that TASCAT has jurisdiction to hear and determine a residential park dispute.

What order can TASCAT make?

Section 98 of the Act gives TASCAT broad powers to resolve residential park disputes. TASCAT does not have jurisdiction under section 98 to award compensation for damages arising from personal injury.
