Decisions after the hearing

If, on reviewing the rejection or dismissal of a complaint the Tribunal is satisfied that the ADC made the correct decision in rejecting or dismissing the complaint, the complaint lapses.

The Tribunal will provide its decision to each party to the proceedings. It will usually be provided in a written decision that is sent to each party.  On some occasions the decision made by made orally on the day of the hearing depending on the urgency of the matter.  A person can request a written decision or may be provided a recording of the reasons for decision.

The Tribunal will aim to issue a decision within six to eight weeks of the hearing.  The timeframe will depend on the complexity of the matter and any existing decisions that need to be issued.

Decisions made in relation to inquiries may be appealed to the Supreme Court within 28 days after the decision was made.
